1. Eligibility

You must be at least sixteen (16) years old to use Tlyport.

If you are using the Service on behalf of an organization, company or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms. In such cases, references to “you” include both the individual user and the represented organization.

2. Description of Service

Tlyport is a digital transfer, sharing and distribution platform that allows users to upload, organize, manage and distribute digital content through links, containers, access controls and related sharing features.

Tlyport is designed primarily as a modern digital distribution and sharing infrastructure. While certain storage functionality may be provided as part of the Service, Tlyport is not intended to function as a guaranteed archival, backup or permanent storage solution.

You acknowledge and agree that:

• independent backups remain your responsibility;
• the Service may evolve over time;
• features may be modified, suspended or discontinued at any time;
• and certain functionality may be subject to limitations, throttling, maintenance or technical constraints.

3. User Accounts

To access certain features, you may be required to create an account.

You agree to:

• provide accurate and complete information;
• maintain the security of your credentials;
• keep your login information confidential;
• and promptly notify us of any unauthorized access or suspicious activity.

You may not:

• share accounts with unauthorized persons;
• resell accounts;
• impersonate others;
• or use accounts in a misleading or fraudulent manner.

Organizations may create and manage accounts on behalf of employees, contractors or team members. Where organizational accounts are used, the organization may retain administrative control over associated data, users, workspaces and content.

You are responsible for all activity conducted through your account.

4. Storage, Transfers & Availability

Tlyport may impose:

• storage limits,
• bandwidth limits,
• transfer limitations,
• fair usage policies,
• and operational restrictions depending on your plan or usage behavior.

Where applicable, storage quotas are enforced based on your subscribed plan. Upload functionality may be restricted once the applicable limit is reached.

Bandwidth and transfer activity may be throttled, restricted or temporarily limited where we determine, in our sole discretion, that usage may:

• negatively impact platform stability,
• constitute abuse,
• create excessive operational strain,
• or violate our Fair Usage Policy.

While Tlyport commercially strives to maintain durable and reliable storage infrastructure, the Service is provided on an “AS IS” and “AS AVAILABLE” basis. We do not guarantee uninterrupted uptime, uninterrupted availability, error-free operation, permanent accessibility or perpetual storage retention.

Temporary interruptions may occur due to:

• maintenance,
• infrastructure upgrades,
• security measures,
• provider outages,
• internet disruptions,
• or events beyond our reasonable control.

5. Shared Links & Access Controls

Tlyport may provide various sharing and access mechanisms, including:

• public links,
• private links,
• PIN-protected access,
• OTP-protected access,
• containers,
• microsites,
• and related access control features.

You acknowledge and agree that:

• anyone possessing a public or improperly shared link may potentially gain access to associated content;
• PIN and OTP features are intended as convenience and security enhancement features and not as guaranteed enterprise-grade security mechanisms;
• you are solely responsible for managing and distributing access credentials appropriately.

Tlyport is not responsible for:

• recipient forwarding,
• unauthorized redistribution,
• compromised email accounts,
• weak passwords or PINs,
• user negligence,
• or misuse arising from improper sharing practices.

Certain shared pages or links may become inaccessible if:

• account status changes,
• container names are modified,
• links are regenerated,
• plans are downgraded,
• or the Service structure evolves.

6. User Content & Ownership

You retain ownership of all files, data, content and materials uploaded through the Service (“User Content”).

By uploading or transmitting User Content through Tlyport, you grant us a limited, non-exclusive, worldwide license to:

• host,
• store,
• process,
• transmit,
• cache,
• reproduce,
• and display such content solely for the purpose of operating, securing and improving the Service.

You represent and warrant that:

• you own or possess the necessary rights to upload and distribute your User Content;
• your User Content does not violate applicable laws or third-party rights;
• and your use of the Service complies with all applicable regulations and obligations.

Tlyport does not claim ownership over your User Content.

7. Acceptable Use

You may not use Tlyport to:

• distribute malware, ransomware or malicious software;
• conduct phishing, scams or fraudulent activities;
• infringe intellectual property rights;
• distribute illegal or unauthorized content;
• facilitate unlawful business activities;
• distribute exploitative or abusive material;
• interfere with platform stability or security;
• bypass usage limitations or access controls;
• attempt unauthorized access to systems or accounts;
• or engage in abusive, harmful or deceptive conduct.

You may not use Tlyport to store or distribute:

• regulated medical records,
• classified government materials,
• regulated financial records,
• highly sensitive legal evidence,
• or other regulated data categories unless you are independently authorized and legally permitted to do so.

Users remain solely responsible for determining whether the Service is suitable for their intended use cases and regulatory obligations.

8. Monitoring, Security & Enforcement

Tlyport may implement:

• automated abuse detection,
• behavioral monitoring,
• metadata analysis,
• malware scanning,
• AI-assisted moderation systems,
• analytics systems,
• and security automation tools.

Tlyport does not routinely inspect the contents of user files through human review. However, we reserve the right to investigate, preserve, review or disclose information where reasonably necessary to:

• comply with applicable laws;
• respond to valid legal requests;
• enforce these Terms;
• protect platform integrity;
• investigate abuse;
• or protect users, infrastructure or third parties.

We reserve the right to:

• remove content;
• disable links;
• suspend transfers;
• restrict regions or jurisdictions;
• block IP addresses;
• throttle bandwidth;
• suspend accounts;
• or cooperate with law enforcement and regulatory authorities.

9. Paid Plans, Billing & Refunds

Certain features of the Service may require payment or subscription enrollment.

By purchasing a paid plan, you agree to:

• pay all applicable fees;
• provide valid billing information;
• and comply with the terms associated with your selected plan.

Unless otherwise stated:

• subscription fees are non-refundable;
• unused periods are non-refundable;
• and partial usage refunds are not provided.

Tlyport may, at its sole discretion, issue goodwill credits or discretionary refunds without obligation to do so in future cases.

We reserve the right to:

• modify pricing;
• introduce new plans;
• revise plan features;
• or alter operational limitations at any time.

10. Downgrades, Suspension & Deletion

If a paid account:

• expires,
• is terminated,
• or becomes inactive,

access to certain features may be suspended or restricted.

Where applicable:

• files may remain retained for approximately thirty (30) days pending reactivation;
• additional notifications may be issued before permanent deletion;
• and accounts that remain within applicable free-tier limits may be downgraded instead of deleted.

After applicable retention periods expire, User Content may be permanently deleted and may no longer be recoverable.

Users remain responsible for independently maintaining backups of important data.

11. Intellectual Property

All rights, title and interest in and to the Tlyport platform, including:

• software,
• branding,
• logos,
• interfaces,
• designs,
• graphics,
• infrastructure,
• and related intellectual property,

remain the exclusive property of Javelin Edge Sdn. Bhd. and its licensors.

You may not:

• reproduce,
• reverse engineer,
• distribute,
• resell,
• exploit,
• or create derivative works from the Service except as expressly permitted.

12. Disclaimers

The Service is provided on an “AS IS” and “AS AVAILABLE” basis.

To the fullest extent permitted by law, Tlyport disclaims all warranties, express or implied, including warranties relating to:

• merchantability,
• fitness for a particular purpose,
• availability,
• non-infringement,
• uninterrupted access,
• security,
• and data preservation.

We do not guarantee:

• uninterrupted uptime,
• perpetual storage retention,
• delivery success,
• error-free operation,
• or complete immunity from security threats.

You acknowledge that use of the Service is at your own risk.

13. Limitation of Liability

To the fullest extent permitted by law, Javelin Edge Sdn. Bhd., Tlyport and their affiliates, officers, employees, contractors and partners shall not be liable for:

• indirect damages;
• consequential damages;
• incidental damages;
• special damages;
• punitive damages;
• loss of profits;
• business interruption;
• reputational harm;
• data loss;
• corrupted files;
• unauthorized access;
• or loss arising from the use or inability to use the Service.

In all cases, our total aggregate liability arising from or related to the Service shall not exceed the amount paid by you to Tlyport during the twelve (12) months preceding the claim.

Some jurisdictions may not permit certain liability exclusions. In such cases, applicable limitations shall apply to the maximum extent permitted by law.

14. Indemnification

You agree to defend, indemnify and hold harmless Javelin Edge Sdn. Bhd., Tlyport and their affiliates, officers, employees and partners from and against any claims, liabilities, damages, losses and expenses arising from:

• your use of the Service;
• your User Content;
• your violation of these Terms;
• your violation of applicable laws;
• or your infringement of third-party rights.

15. Changes To Service

Tlyport may:

• modify,
• suspend,
• discontinue,
• replace,
• or evolve any part of the Service at any time without liability.

This includes:

• features,
• plans,
• infrastructure,
• operational models,
• storage policies,
• bandwidth policies,
• access methods,
• security systems,
• and experimental or beta functionality.

Certain features may be identified as experimental, beta or early-access features and may be subject to instability, limited support or future removal.

16. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Malaysia.

Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Kuala Lumpur, Malaysia.

18. Entire Agreement

These Terms constitute the entire agreement between you and Tlyport regarding the Service and supersede any prior agreements, understandings or representations relating to the Service.

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
